Terms and Conditions
Independent Software Vendors (ISV) may apply to Epson to list their software applications as being compatible with Epson's TM-intelligent printers. The applications will be approved on the terms below:
- An ISV must accurately complete all sections of the application form on www.epson.ae/en/isv.
- After consideration of an ISV's application Epson may in its sole decision approve that the ISV's software applications be listed as being compatible with Epson TM-intelligent printers. No correspondence will be entered into in respect of any application which Epson does not approve.
- An ISV is required to show results of tests it has carried out as proof that its software application is compatible with Epson TM-intelligent printers.
- All details which an ISV provides must be true and accurate.
- Epson shall communicate the outcome of the application to the ISV.
- An ISV's software application will be listed as being compatible with an Epson TM-intelligent printer for a 1 year period. ISVs will have the option to renew their application at the end of the period. ISVs may be required to provide proof of continuing compatibility of their software applications with Epson TM-intelligent printers.
- An ISV will provide Epson with a list of all its software applications which are compatible with the Epson TM-intelligent printers.
- Each ISV's compatible software will be listed on Epson websites, promotional materials or point of sales materials related to the TM-intelligent printers.
- Listing an ISV's software on an Epson website, promotional materials, point of sales material or any other marketing material does not mean Epson validates the ISV's software. For the avoidance of doubt, Epson does not approve, recommend, certify, authenticate, validate or give any warranties on the quality, effectiveness, durability, suitability or otherwise of an ISV software.
- The ISV programme is only a referral programme. It is a means of notifying Epson customers of available software applications which are compatible with the Epson TM-intelligent printers.
- Each ISV has the responsibility to ensure that its software is free of virus, errors and defects.
- Each ISV is solely responsible for upgrading its software to achieve compatibility at all times with Epson TM-intelligent printers or its later models.
- Epson will inform ISVs of the release of new models of the Epson TM-intelligent printers.
- Each ISV is solely responsible for notifying customers of upgrades it makes to its software applications.
- An ISV may in its sole discretion contract with an Epson customer that wishes to buy the ISV's software. Such sale between the ISV and an Epson Customer will be on terms agreed by both parties. Epson does not set or influence the terms on which both parties contract.
- Epson does not guarantee any minimum volume of sales of software by an ISV due to the listing of the ISV's software on Epson websites or promotional materials.
- Both Epson or an ISV are free to withdraw from this programme at any time by giving the other party 1 week's notice.
- Epson may remove the list of an ISV's software from Epson websites and promotional materials if the compatibility of an ISV software with Epson TM printers consistently fails over a period of time.
- An ISV is allowed to refer to its listed software as being compatible with Epson TM-intelligent printers. An ISV can make such reference on its websites or any other marketing communications. An ISV shall not mislead customers on the scope or extent of its collaboration with Epson. In particular ISVs must not represent to customers that Epson certifies, approves or otherwise gives any warranties in respect of the ISV's software.
- ISVs shall not use Epson's trademark in a way that disparages the Epson brand, printers or services, or portrays Epson printers or services in a false, competitively adverse or poor light.
- These terms and conditions are governed by the laws of the country of the Epson entity to which you have submitted your application.
- By submitting an application each ISV confirms that it has read, understood and accept these terms & conditions.
